Duncan, Elizabeth Duncan, Joseph E. Duncan, ( ) A. Duncan, John Duncan, Winny Duncan, Sarah Duncan, ( ) Duncan, Cary Duncan, Sarah ( ), and William R. Moore of Smith County, Martha ( ) , and John Moore of Sumner County. William H. Allen states that sometime in the year 1839, John Duncan purchased a certain tract of land in DeKalb County from one Reuben (Brown) for the sum of $610. He paid $200 down. He executed his notes for the remainder. Said Brown executed a deed in fee simple for the land to said John Duncan. Duncan shortly thereafter took possession of said land by remaining upon the land. Sometime in Oct 1839, said Duncan departed this life intestate, leaving the said Susannah, his widow, and Nancy who had intermarried with Lilburn Chandler, Catherine who had intermarried with George Grayston, (Richard) M., Elizabeth, Joseph, Jessie, John L., Winney, Sarah H., L ( ), and Cary R. In Smith Co. TN Chancery Court Record Book 2
William HALLUM versus William HART Et Al. The bill of complaint of William Hallum of Davidson County against William Hart, and Jefferson Rowland of Smith County; and George Rowland of Arkansas. On 26 Dec 1828, George Rowland was indebted to the said William Hallum in the amount of $385 for which he executed his note. The said George has been for some years and is now a non resident of this State, and has been generally unable to pay the amount. But by the death of his father, he became entitled to a distributive part of his estate. The negroes of David Rowland deceased is a part of which the said George is entitled as a distributee and legatee of said David. The slaves were sold under a decree of court. Hallum has made some exertion to get his debt satisfied. He is apprehensive that the money from the sale may be taken out of the State. The said David left a will by which he directed that his property be equally divided into six parts and the said George is entitled to one part. Hallum is asking the court to injoin Hart and Jefferson Rolwand from paying over to said George Rowland any part of said fund until further order from the court. Feb. 1841. (p.222-224)

ROWLAND versus PAYNE. The bill of complaint of James Rowland as guardian for Mary Ann Rowland, James C. Rowland, Sally E. Rowland, and George F. Rowland, his minor children; David W. Denton and wife Elizabeth, and Jacob W. Roe and wife Martha against John Payne and Joseph Payne, all of Smith County. William Payne made his will in 1835 and died in 1836. He appointed his sons, John and Joseph, as his executors. There was devised to the widow for life a tract of land on which he lived, containing 83 acres. The widow died in Nov 1837. Joseph Payne received a negro woman named Peggy and a boy named Gideon. John Payne received a negro woman named Cate and a boy named Carrol. The said William Payne left at the time of his death four children, namely, the said Joseph and John Payne; Ann Carpenter; and Patsy Rowland, the latter of whom is now dead. James Rowland was the husband of the said Patsy. He was appointed guardian for all of his and her children, being eight in number. David W. Denton has recently married said Elizabeth. Jacob W. Row has intermarried with the said Martha, both being daughters of the said Patsy Rowland, the daughter of the said William Payne. Complainants insist that they are entitled by law to one fourth of the said land. 9 Feb 1841. (p.630-639)
